Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Omeganodes platform, websites and APIs (together, the “Service”) operated by Omega Nodes Company Ltd, a company incorporated in Uganda (“Omeganodes”, “we”, “us”). Company details are at the end of these Terms. By creating an account or using the Service you agree to these Terms. If you are using the Service on behalf of an organisation, you represent that you are authorised to bind that organisation.

Omeganodes is a Platform-as-a-Service that lets you deploy and run applications, databases and related workloads. Features, limits and plan inclusions are described on our pricing page and may change as the Service evolves.

You are responsible for the activity under your account and for keeping your credentials secure. You must provide accurate registration details and notify us promptly of any unauthorised use. One person or organisation may not maintain multiple free-tier accounts to circumvent plan limits.

You agree not to use the Service to host or transmit content or workloads that:

• are unlawful, infringing, or violate the rights of others;
• distribute malware, run denial-of-service attacks, or attempt to breach any system;
• send unsolicited bulk messaging (spam) or operate phishing infrastructure;
• mine cryptocurrency or otherwise abuse shared compute beyond your plan allowance.

We may suspend workloads that threaten the stability, security or lawful operation of the platform.

Paid plans and add-ons are billed in advance. Prices are denominated in euros (EUR) and include VAT where it applies; amounts shown in other currencies (such as UGX or USD) are conversions for convenience.

Regional prices. Your price depends on your billing country: one price for the EU/EEA and other advanced economies, and lower regional prices elsewhere, as shown on the pricing page. The billing country you give must be accurate. If it is not, we may ask you to confirm it and apply the price of your actual country from the next renewal.

Price changes. We tell you by email at least 30 days before a new price applies to your next renewal. If you do not accept it, you can cancel before the renewal and keep your plan until the end of the period you paid for.

• Card (Stripe) and PayPal payments are collected and invoiced by Omega Nodes Italia di Francesco Galleano (trading as ThinkPink Studio), Italy, on behalf of Omeganodes. Your purchase is activated as soon as the payment succeeds.
• MTN Mobile Money, Airtel Money and bank transfer are paid manually: you follow the instructions shown at checkout and send us the transaction reference. Our team confirms the payment and activates your purchase, usually within one working day. These payments are invoiced by Omega Nodes Company Ltd.

Fees are non-refundable except where required by law, including any statutory right of withdrawal that applies to you as a consumer. You can set a spending budget and cancel at any time; access continues until the end of the paid period.

If you are a consumer in the European Union you may withdraw from a purchase within 14 days of it, without giving a reason. By paying, you ask us to start the Service straight away. If you then withdraw within the 14 days, we refund what you paid minus the part of the Service already provided (in proportion to the days used), within 14 days of your request, with the same payment method.

To withdraw, send a clear statement to info@omeganodes.ai or open a support ticket, for example: “I withdraw from my purchase of [plan or add-on] of [date], account [email].” Businesses and customers outside the EU do not have this right, but can still cancel at any time as described above.

We work to keep the Service available and reliable, but it is provided on an “as is” and “as available” basis. Planned maintenance and factors outside our control may cause downtime. Any service-level commitments, where offered, are described in your plan.

Free plan. Free apps run on shared economy servers on a best-effort basis, with no availability or performance commitment. They may be slower, paused when idle or under load, or moved to another server. Paid plans run on separate servers that do not host free apps.

You retain all rights to the code, data and content you deploy. You grant us the limited rights needed to operate the Service on your behalf (for example, to store, transmit and run your workloads). You are responsible for having the rights to everything you upload.

When your content includes personal data of others (your users, customers or staff), you are its controller and we process it only on your instructions, under our Data Processing Agreement, which forms part of these Terms.

You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms, non-payment, or to comply with the law. On termination we will delete or anonymise your data as described in our Privacy Policy.

To the maximum extent permitted by law, Omeganodes is not liable for indirect, incidental or consequential damages, or for lost profits or data. Our aggregate liability for any claim is limited to the amount you paid for the Service in the three months before the claim arose. This does not limit liability for wilful misconduct or gross negligence, or the rights the law gives consumers.

These Terms are governed by the laws of the Republic of Uganda, without regard to conflict-of-law rules. Mandatory consumer-protection rights in your country of residence are unaffected, including a consumer’s right to go to the courts where they live.

We may update these Terms from time to time. If we make material changes we will notify you (for example, by email or an in-product notice) and ask you to accept the new version the next time you sign in. We record which version you accepted and when.
