Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Omeganodes platform, websites and APIs (together, the “Service”) operated by Omeganodes Ltd (“Omeganodes”, “we”, “us”). By creating an account or using the Service you agree to these Terms. If you are using the Service on behalf of an organisation, you represent that you are authorised to bind that organisation.

Omeganodes is a Platform-as-a-Service that lets you deploy and run applications, databases and related workloads. Features, limits and plan inclusions are described on our pricing page and may change as the Service evolves.

You are responsible for the activity under your account and for keeping your credentials secure. You must provide accurate registration details and notify us promptly of any unauthorised use. One person or organisation may not maintain multiple free-tier accounts to circumvent plan limits.

You agree not to use the Service to host or transmit content or workloads that:

• are unlawful, infringing, or violate the rights of others;
• distribute malware, run denial-of-service attacks, or attempt to breach any system;
• send unsolicited bulk messaging (spam) or operate phishing infrastructure;
• mine cryptocurrency or otherwise abuse shared compute beyond your plan allowance.

We may suspend workloads that threaten the stability, security or lawful operation of the platform.

Paid plans and add-ons are billed in advance. Prices are denominated in euros (EUR); amounts shown in other currencies (such as UGX or USD) are conversions for convenience. You may pay by card or supported mobile money providers (Airtel Money, MTN Mobile Money). Fees are non-refundable except where required by law. You can set a spending budget and cancel at any time; access continues until the end of the paid period.

We work to keep the Service available and reliable, but it is provided on an “as is” and “as available” basis. Planned maintenance and factors outside our control may cause downtime. Any service-level commitments, where offered, are described in your plan.

You retain all rights to the code, data and content you deploy. You grant us the limited rights needed to operate the Service on your behalf (for example, to store, transmit and run your workloads). You are responsible for having the rights to everything you upload.

You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms, non-payment, or to comply with the law. On termination we will delete or anonymise your data as described in our Privacy Policy.

To the maximum extent permitted by law, Omeganodes is not liable for indirect, incidental or consequential damages, or for lost profits or data. Our aggregate liability for any claim is limited to the amount you paid for the Service in the three months before the claim arose.

These Terms are governed by the laws of the Republic of Uganda, without regard to conflict-of-law rules. Mandatory consumer-protection rights in your country of residence are unaffected.

We may update these Terms from time to time. If we make material changes we will notify you (for example, by email or an in-product notice). Continued use after changes take effect constitutes acceptance.
